42 USC 1983 and Bivens Actions for Violations of Firearms Rights by State and Federal Actors
The violation of an individual’s civil liberties, including the Right to Keep and Bear Arms (RKBA), is compensable through either 42 USC 1983 or a Bivens action, depending on whether the deprivation was caused by a State or Federal agent. This means if you were wrongfully detained or charged (assuming the charges were dismissed or a verdict of not guilty was entered), you may have the ability to sue the officer, his commanding officer, and/or the municipality for the deprivation of your Rights.
